Guardianship, What is the Guardianship Trap? To understand the hallmarks of this Trap we must take a look at the playbook from which the Judges and Court officials using ‘Color of Law’ operate.
“The Guardianship Abuse Playbook”
Though the particulars of each story differ, the playbook is like a rehearsed script:
- TARGET the person with desirable assets. Intercede in their lives.
- INVOLVE Social Services. Claim negligence, abuse, or exploitation.
- PETITION for emergency Ex Parte Hearing. Declare victim incapacitated.
- FREEZE assets. Confiscate jointly held bank accounts and annuities.
- DEFAME family members so they can’t be named guardians.
- OVERRIDE or ignore existing guardianship(s), durable and medical POA’s.
- ESTABLISH 24/7 supervision. Deem home unsafe. Relocate ward.
- ISOLATE ward, monitor phone calls, mail, internet, and visitors.
- ACCUSE visitors of crimes, abuse, trespassing, or “upsetting the ward.”
- INSTITUTE costly supervised visitation, and/or issue restraining orders.
- INCAPACITATE ward with pain killers and psychotropic drugs.
- CONFISCATE cars, bank vaults, life insurance, IRA’s, stocks, bonds, etc.
- RELOCATE victims far away into group homes, nursing or hospice facilities.
- DELAY notifying family of death, no autopsy.
- BANKRUPT ward and family through endless legal battles.

“The Guardianship Abuse Trap”
According to this May 16, 2023, article in Philanthropy news (Candid.): The New York Times reports an estimated eighty-four trillion dollars ($84 trillion) is projected to be passed down from older Americans to gen X and younger heirs through 2045, and $16 trillion will be transferred within the next decade. In 1989, family wealth in the U.S. was about thirty eight trillion dollars ($38 trillion), adjusted for inflation. By 2022, that wealth had more than tripled, reaching one-hundred-and-forty trillion dollars ($140 trillion), with boomers benefiting in the financial and housing markets. When courts get involved the inter-generational transfer of wealth gets diverted. To summarize and reiterate the pattern of abuse, they
- SEIZE – complete control of your life and assets
- APPOINT – total strangers as “guardians”
- OVERRIDE – carefully prepared legal documents
- ISOLATE – from family and loved ones
- MEDICATE – against your will
- LIQUIDATE – life savings with impunity
